WEDDING PHOTOGRAPHY TERMS AND CONDITIONS

The following words or expressions shall have the meanings stated:

'the Photographer(s)' means Andy Webb or other photographers employed by Andy Webb Photography

'Images' means all photographs, prints, transparencies, images, negatives, digital scans, digital files, albums, design, artwork, montages, drawings, engravings and/or any other photographic product or other product comprising or containing reproduction of any form of photographic material, and which has been created by the Photographer.

'Price' means the price as agreed at the time of the booking.

 'Contract' means the agreed (wedding) package and timings between Photographer and Client of which these terms are an integral part.

1. Exclusive Photographer.
The Photographer shall be the exclusive photographer retained by the Client for the purpose of photographing the wedding. Family and friends of the Client shall be permitted to photograph the wedding as long as they shall not interfere with the Photographer’s duties and do not photograph poses arranged by the Photographer.


2. Wedding non refundable retainer fee.
The non refundable retainer fee of £200 secures the time and services of the photographer(s) for the wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by "Andy Webb Photography" due to cancellation.

3. Cancellation

If the client cancels the wedding the following conditions apply:

Within a 3 month period before the wedding date full payment is required.

Within 3 to 6 months before your wedding date 50% of the balance owed is due.

Within 6 to 9 months before your wedding date 25% of the balance owed is due.

All cancellations must be in writing to Andy Webb Photography, The Garden Cottage, High Street, Bramley Surrey. GU5 0HG. Weddings that are postponed to a later date will retain the fee as long as The Photographer(s) can re-schedule for the new date and time.

4. DELIVERY and COLLECTION:

Please allow up to 28 days before collection or delivery of your photographs.

With packages that include a traditional style album and framed prints, these are only available up to 6 months after you receive your proof album. No refund is given, it is the clients responsibility to contact the photographer within this period.



5. Wedding Payments

Following payment of the booking fee, the balance of fees due are to be paid 14 days prior to the wedding. Final photographs, Albums, CD’s and DVD’s will not be delivered until all payments due have been paid in full. Payment for additional images is to be made when they are ordered.

Shipping charges will apply where necessary. There will be a £25.00 charge for all deliveries on albums and prints. Individual orders incur separate charges.

Photography time over the agreed time will be charged at £100.00 per hour (or part of) and invoiced to the client, payable within 7 days of receipt of invoice.

6. Special Requests/Coverage
The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instructions, although every effort is made to comply with client’s wishes. All digital cosmetic enhancements shall require written authorisation. Which shall be required before printing commences.

Andy Webb Photography cannot be held responsible for the lack of coverage caused by: the wedding couple or wedding party not being on time, the Church, Register Office, or licensed venue of wedding having restrictions regarding photography. The Photographer does not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.

It is the wedding couples responsibility to instruct Andy Webb Photography if they do not require candid/informal photographs taken on the day. If the wedding couple require other formal photographs other than the list supplied it is the Bride and Grooms responsibility to instruct Andy Webb Photography of the photographs they want taken. Andy Webb Photography accepts no liability for any formal group/formal photographs not taken if  the wedding couple do not supply a list of said photographs or the wedding couple ask for them not to be taken on the day for any reason whatsoever.

If the formal wedding photographs are to be taken after daylight hours it is the Bride and Grooms responsibility to source a suitable location to take the photographs, Andy Webb Photography accepts no responsibility for outdoor light conditions.

Due to technical processing, Andy Webb Photography cannot guarantee exact colour matching.

Andy Webb Photography cannot be responsible for print selection errors whether re-prints or album prints including albums that have incorrect images due to client error a charge will be made for re-album design.

Andy Webb Photography cannot be responsible for the damage to CD’s provided, appropriate care is the client’s responsibility.

 All albums, proofs, disks etc should be collected in person from Andy Webb Photography unless other arrangements are made.

Andy Webb Photography accepts no responsibility for the reliability of the post. We cannot be held responsible for loss or damage of mail, prints, albums frames and disks etc that are sent through the post unless sent by recorded delivery for which the client shall reimburse charges incurred by Andy Webb Photography.

7. Images
All image sizes are nominal. "Andy Webb Photography" will provide an acceptable colour balance but cannot guarantee exact colour matching.

8. Previews
Although "Andy Webb Photography" will do their best to produce a certain amount or more images as discussed with the client, there is no guarantee that any particular number of images will be produced.

9. Retouching
Retouching, digital manipulation and artist finishing is available to the Client as an optional extra.

10. Reorders

All re-orders shall be considered an extension of this contract. All re-orders must be paid for in full prior to orders being dispatched.

E-mail correspondence shall be sufficient to prove changes to agreements for the formand content of programmes as long as it is acknowledged with a response.

11. Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer(s) in writing.
All chosen and final images will be supplied to the client on CD or DVD which will include a copyright release for those photographs, allowing the client to print their own copies of such images as included on the CD or DVD for personal use by the bride and groom and their friends and relatives. Selling, Publication or any Commercial use of the photographs is not allowed without prior written permission from the Photographers.

12. Negatives/Digital Files
Negatives/digital files remain the property of "Andy Webb Photography".

13.WEATHER & ILLNESS:

Andy Webb Photography cannot be held responsible for images and photography sessions being disrupted by adverse/unfavourable weather conditions. Andy Webb Photography shall not be liable for any amount in excess of the retail value of your package. Andy Webb Photography may substitute photographers to take photographs at your wedding in the event of photographer’s illness.

Andy Webb Photography shall be under no liability if unable to carry out any provision of the contract for any reason beyond its control including (without limiting the foregoing) Act of God, legislation, war, fire, flood, drought, failure of power supply, lock-out, strike or other action taken by suppliers or owing to any inability to procure materials required for the performance of the contract. During the continuance of such a contingency the client may, by written notice to Andy Webb Photography elect to terminate the contract and pay for work done and materials used but subject thereto shall otherwise accept delivery when available.

14. Refund Policy
We will not refund, nor accept the return of/refusal to pay charges for, any technically acceptable photograph supplied either in print or in electronic format. No exception can be made as we cannot be held responsible for individual tastes or exceptions.

 15. Complaints
Any complaints should first be raised by the Client with "Andy Webb Photography in writing no later than 7 days from the date of receipt of images.

Terms and conditions are subject to change at any time without prior notice.

PRIVACY POLICY

1. Personal Information
On some of the "Andy Webb Photography" Web pages you can order products and make requests with reference to site content. The types of information collected at these pages are name, address, contact and billing information, transaction, and credit card information. All personal Information we collect from you to complete transactions and process any of your online purchases are used to communicate back to you, update you on our service and benefits, to provide you with information regarding our products and promotions, to support your use of our services. You always have the right to choose whether or not to provide information about yourself to "Andy Webb Photography". If you choose not to provide such information, you may be restricted on what is accessible on the site and will not be informed of any upcoming events or offers.

2. Credit cards and Online Payments
"Andy Webb Photography" do not store any Credit/Debit card numbers. They are only used to process payments and are not retained for any other purpose. All Card transactions for the "Andy Webb Photography" site are conducted using PayPal.
